Abstract

Examines the views of alternative dispute resolution practitioners and academics on the feasibility of using an arbitration/mediation/arbitration (Arb/Med/Arb) process before the same neutral, who first serves as an arbitrator, then a mediator and then an arbitrator again if the mediation fails, to resolve international commercial disputes, including on the enforceability of the awards produced. Presents a glossary of relevant terms.
